Article 1 - Prerequisites

1.1 These Terms of Service govern the usage conditions applicable to the services provided by the server accessible at the web address https://www.kajakorea.com. All of these services are collectively referred to as the Service.

1.2 Users of the Service (hereinafter referred to as the User) acknowledge having read these Terms of Service and agree to fully comply with them without reservation.

Article 2 - Legal Notice

2.1 KajaKorea is a service owned by KajaKorea Inc.

2.2 The publishing director is Mr. Kévin Selleron.

2.3 KajaKorea is hosted by OVH.

Article 3 - Data Protection

3.1 In compliance with international data protection standards, including the GDPR for users within the European Union and applicable South Korean data protection laws, you have the right to access, modify, rectify, and delete your personal data.

Article 4 - Restrictions

4.1 By using the Service, you represent and warrant that the information about you is accurate, that you will maintain the accuracy of this data, that you are at least 14 years old, and that your use of the Service does not violate any applicable laws or regulations. Your profile may be deleted, and your membership may be terminated without notice if we believe you are not complying with these rules.

4.2 Information provided by other users of the Service (via their posts, comments, profiles, etc.) may include inaccurate, inappropriate, or offensive content that violates these Terms of Service. KajaKorea assumes no responsibility or liability for such content. If you observe any misuse of the Service, please contact us promptly.

4.3 KajaKorea reserves the right, at its sole discretion, to reject, refuse to publish, or remove any content (including private messages) during your activities on the application or to restrict, suspend, or terminate your access to any part of the Service at any time, for any reason or no reason, with or without notice, and without liability.

Article 5 - Content Ownership Rights

5.1 KajaKorea does not claim ownership of the text, files, images, messages, photos, videos, sounds, musical works, authorship works, or any other material, data, or information (collectively referred to as "Content") that you post on the Service. By posting your Content on the Service, you retain all ownership rights to your Content and continue to have the right to use your Content as you choose.

5.2 By displaying or publishing any Content on or through the Service, you grant KajaKorea a license to use, copy, modify, publicly perform, publicly display, reproduce, and distribute the Content, prepare derivative works, incorporate the Content into other works or Content, and sublicense the Content and any derivative works. Without this license, KajaKorea would be unable to provide the Service.

5.3 The license you grant to KajaKorea is irrevocable, perpetual, transferable, non-exclusive, fully paid, royalty-free, sublicensable, and worldwide.

5.4 You represent and warrant that you own the Content posted by you on or through the Service or have the right to grant the license set forth in this section, and that posting your Content on or through the Service does not violate privacy rights, publicity rights, copyrights, contractual rights, or other rights of any person. You agree to pay all royalties, fees, and other amounts due to any person by reason of any Content posted by you or through the Service.

5.5 The Service contains content from KajaKorea that is protected by copyright, trademark, patent, trade secret, and other laws, and KajaKorea owns and retains all rights in the Service content. KajaKorea grants you a limited, revocable, non-sublicensable license to reproduce and display the content (excluding any software code) solely for your personal use in connection with viewing the Service via the Internet.

5.6 Except for Content you have posted yourself, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content appearing on or through the Service.

Article 6 - Displayed Content

6.1 You are solely responsible for the Content you display on or through the Service, any material or information you transmit, and any interaction with other users. KajaKorea does not endorse and has no control over such Content.

6.2 Content is not necessarily reviewed by KajaKorea before being posted and does not reflect the opinions or policies of KajaKorea. KajaKorea makes no warranties, express or implied, regarding the Content or the accuracy and reliability of the Content or any material or information transmitted to other users.

6.3 The following list includes prohibited Content and activities on or through the Service. This list is not exhaustive and may include additional rules for community respect, decency, and legal compliance. Prohibited on the Service:

• Using the Service in a manner inconsistent with any applicable laws and regulations
• Posting pornographic, racist, sectarian content, or content inciting hatred against an individual or group
• Posting shocking content or links to adult websites
• Posting content containing restricted or password-protected pages or hidden images (not linked to accessible pages)
• Engaging in any illegal activities or posting related Content
• Threatening, harassing, or insulting an individual or group
• Posting commercial activities without KajaKorea's authorization
• Unauthorized advertising for any app or activity
• Automated system use (e.g., scripts), bots, or data scraping
• Impersonating a member or third party
• Selling or transferring your profile

Article 7 - Responsibilities

7.1 KajaKorea is not responsible for any incorrect or inaccurate Content posted on or through the Service, whether caused by Service users or any equipment or programming associated with or utilized in the Service.

7.2 Any Content posted by Service users may contain links to other websites. KajaKorea is not responsible for the Content of these websites, which are not monitored, reviewed, or verified by KajaKorea. The inclusion of any applications or links on the Service does not imply endorsement by KajaKorea. When you access third-party applications, you do so at your own risk. KajaKorea is not responsible for third-party advertisements displayed on or through the Service or for the goods and services provided by these advertisers.

7.3 KajaKorea is not responsible for the online or offline conduct of any Service user. KajaKorea assumes no responsibility for errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication line failures, theft, destruction, unauthorized access, or alterations to user communications.

7.4 KajaKorea is not responsible for any technical issues or failures, including network or telephone line problems, computer systems, servers, providers, hardware, or software issues. This includes failures of email services caused by technical problems or internet congestion. KajaKorea is not liable for any injury or damage to users or their devices resulting from their participation in, or downloading of materials from, the Service, or from the conduct of any Service user, whether online or offline.

7.5 KajaKorea is not responsible for lost login credentials to the Service's member area or for any misuse of accounts resulting from user negligence. Users are entirely responsible for keeping their login credentials secure. You agree not to use another member's account or disclose your password to third parties. Notify KajaKorea immediately if you suspect unauthorized use of your account or access to your password. You are solely responsible for any activity on your account. For your safety, we recommend not sharing private information such as your phone number, address, last name, or other personal details. KajaKorea cannot be held liable for any misuse of such information if published without obligation by the Service.

7.6 The Service is provided "as is," and KajaKorea expressly disclaims any warranties of fitness for a particular purpose or non-infringement. KajaKorea does not guarantee or promise any specific results from using the Service.

7.7 Under no circumstances will KajaKorea, its directors, officers, employees, or agents be liable to you for any direct, indirect, incidental, special, exemplary, or consequential damages resulting from:

• Errors or inaccuracies in Content
• Personal injury or property damage of any kind arising from your access to or use of the Service
• Unauthorized access to or use of our secure servers and/or any personal or financial information stored therein
• Interruptions or cessation of transmissions to or from the Service
• Bugs, viruses, trojans, or similar threats transmitted via or through the Service by a third party
• Errors or omissions in Content, or for any loss or damage resulting from the use of any Content posted, emailed, or otherwise made available via the Service

7.8 This limitation of liability applies to the fullest extent permitted by law in the applicable jurisdiction. You acknowledge that KajaKorea is not liable for defamatory or unlawful conduct by third parties and that the risk of harm or damage rests entirely with you.

7.9 KajaKorea will not be held liable in cases of force majeure or events beyond its control.

Article 8 - Indemnification

8.1 You agree to indemnify and hold harmless KajaKorea, its subsidiaries, affiliates, officers, agents, partners, and employees from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Service in violation of this agreement or any breach of your representations and warranties set forth in these Terms of Service. This includes any Content you post on or through the Service that causes KajaKorea to be liable to another.

Article 9 - Modifications to the Terms of Service

9.1 KajaKorea may modify these Terms of Service at any time. It is the User's responsibility to regularly review the current Terms of Service. Any clause of these Terms of Service that contradicts mandatory rules, whether in whole or in part, will be severable. The invalidity of one clause will not affect the validity of the remaining provisions.

9.2 These Terms of Service represent the entire agreement between the User and KajaKorea.

Article 10 - Applicable Law and Jurisdiction

10.1 In case of disputes, the prevailing Terms of Service will serve as the legal basis. These Terms of Service are governed by South Korean law, excluding any other legal frameworks. Users and visitors to the Service agree that the jurisdiction is established in the appellate court of Seoul, South Korea.

10.2 This agreement is accepted when you use the Service. KajaKorea’s failure to exercise or enforce any right or provision of this agreement does not constitute a waiver of such right or provision.

10.3 Section titles in this agreement are for convenience only and have no legal or contractual effect.

10.4 This agreement, and any rights and licenses granted under these Terms of Service, may not be transferred or assigned by you but may be assigned by KajaKorea without restriction.

10.5 By using the Service, you acknowledge that you have read this agreement and agree to all the provisions contained herein.
